These Terms of Service ("Terms") apply to your use of Store Elements for Tebex ("the App", "we", "us", or "our"), a trading name of Callum Hull.
By installing or using the App, you agree to these Terms. If you do not agree to these Terms, you should not install or use the App.
1. What the App does
Store Elements for Tebex lets Wix site owners connect their Tebex webstore and display Tebex packages, baskets, and store-related elements on their Wix website.
The App provides display and connectivity tools only. It is not a payment processor, merchant of record, checkout provider, tax service, legal service, or refund handling service.
Tebex remains responsible for Tebex checkout, payments, baskets, purchases, authentication links, fraud checks, tax handling where applicable, and related Tebex services. Wix manages app installation, billing, trials, subscriptions, and related account permissions.
2. Relationship with Wix and Tebex
Store Elements for Tebex is an independent app. It is not operated by, owned by, endorsed by, or officially affiliated with Tebex or Wix unless we clearly state otherwise.
Your use of Wix and Tebex is also subject to their own terms, policies, and requirements. You are responsible for complying with any terms that apply to your Wix site, your Tebex store, and your customers.
3. Who may use the App
You may use the App if you are legally able to enter into these Terms and you have authority to install apps on the relevant Wix site.
If you install or use the App on behalf of a business, organisation, or store, you confirm that you have permission to do so and that the business, organisation, or store agrees to these Terms.
4. Licences, billing, and subscriptions
Each App licence allows one instance of the App to run on one Tebex store. Each valid licence gives access to the full feature set of the App, unless we clearly state otherwise.
App billing, free trials, subscriptions, renewals, cancellations, and refunds are managed through Wix and are subject to Wix's billing terms and processes.
We may use Wix billing, licence, subscription, and installation information to confirm whether your App instance has access to the App.
If your subscription, licence, or billing status is invalid, expired, cancelled, or unavailable, access to some or all App functionality may be restricted.
5. Your responsibilities
You are responsible for your Wix site, Tebex store, store content, package descriptions, prices, images, terms, policies, customer communications, and legal compliance.
You are also responsible for making sure that your use of the App is lawful and does not breach Wix's or Tebex's terms.
You must not use the App to:
- Sell illegal, fraudulent, infringing, harmful, or abusive products or services.
- Mislead customers about pricing, delivery, refunds, ownership, or affiliation.
- Breach the terms or policies of Wix, Tebex, Discord, or any other connected service.
- Attempt to bypass App licensing, billing, security, or access controls.
- Reverse engineer, copy, resell, sublicense, or misuse the App.
- Interfere with the App's operation, infrastructure, security, or availability.
- Send excessive, abusive, automated, or malicious traffic through the App.
- Upload, submit, or transmit malware, harmful code, or unlawful content.
We may suspend or restrict access to the App if we reasonably believe that these Terms have been breached or that continued access could cause harm to us, our users, our infrastructure, Wix, Tebex, or any third party.
6. Store purchases, refunds, and customer issues
Purchases made by visitors through Tebex checkout are not processed by us. We do not handle payment card data and we do not control Tebex checkout decisions.
Refunds, chargebacks, payment disputes, fraud checks, tax handling, order fulfilment, and delivery of digital items are primarily handled by Tebex and/or the relevant store owner.
If a customer has an issue with a purchase, they should usually contact the store owner or Tebex, depending on the issue.
7. Uninstalling the App
If you uninstall the App from your Wix site, access to App functionality may stop and App-powered store elements may stop working or be removed from your site.
Some installation, billing, licence, support, diagnostic, or anti-abuse records may be retained for a limited period as described in our Privacy Policy.
8. Changes to the App
We may update, improve, modify, suspend, or remove parts of the App from time to time. This may include changes to features, design, compatibility, APIs, or technical requirements.
We will try to avoid unnecessary disruption, but we cannot guarantee that every feature will always remain available or unchanged.
9. Availability and support
The App is provided on an "as is" and "as available" basis. We do not guarantee that the App will always be uninterrupted, error-free, secure, or compatible with every Wix site, Tebex store, browser, device, theme, custom code setup, or third-party service.
We may provide support, but we do not guarantee a specific response time, fix time, or outcome unless we have separately agreed this in writing.

10. Third-party services
The App depends on third-party services, including Wix, Tebex, Discord, Cloudflare, Resend, and hosting/database providers.
We are not responsible for outages, errors, data issues, policy changes, API changes, billing decisions, checkout decisions, or account restrictions caused by third-party services.
If Wix, Tebex, Discord, or another connected service changes or removes functionality, the App may stop working fully or partly.
11. Intellectual property
The App, including its software, design, branding, dashboard, widgets, code, and related materials, belongs to us or our licensors.
You are granted a limited, non-exclusive, non-transferable licence to use the App for your own Wix site and connected Tebex store while you have a valid installation and licence.
You do not receive ownership of the App, its code, or its underlying technology.
12. Feedback
If you send us feedback, ideas, suggestions, bug reports, or feature requests, we may use them to improve the App without owing you payment or credit.

By using the App, you agree that we may collect and use information as described in our Privacy Policy.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from your use of the App.
We are not responsible for lost sales, lost revenue, lost data, failed checkouts, store downtime, customer disputes, refund issues, tax issues, payment issues, Tebex account issues, Wix account issues, or third-party service failures.
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including liability for fraud or for death or personal injury caused by negligence.
15. Indemnity
You agree to indemnify and hold us harmless from claims, losses, costs, damages, liabilities, and expenses arising from:
- Your Wix site or Tebex store.
- Your products, packages, pricing, descriptions, or customer communications.
- Your breach of these Terms.
- Your breach of Wix, Tebex, Discord, or other third-party terms.
- Your unlawful, misleading, infringing, or harmful use of the App.
16. Termination
We may suspend or terminate your access to the App if you breach these Terms, misuse the App, fail to maintain a valid licence, or create legal, security, operational, or reputational risk.
You may stop using the App at any time by uninstalling it from your Wix site and cancelling any related subscription through Wix.
17. Changes to these Terms
We may update these Terms from time to time. If we make changes, we will update the "Last updated" date.
Continued use of the App after changes are made means you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of England and Wales.
Any disputes relating to these Terms or the App will be subject to the courts of England and Wales, unless applicable law requires otherwise.
